THIS IS A SINGLE USE LICENSE FOR ONE PRODUCT. YOU AGREE TO REPURCHASE EACH IMAGE USED WITHIN YOUR PRODUCT EACH TIME YOU SELL OR DISTRIBUTE A COPY OF YOUR PRODUCT.
In other words if you use a BigStockPhoto.com image of a horse within your product, and you sell or give away this product to 3 people, you must purchase the image of the horse at BigStockPhoto.com three times.
Permitted Uses.
You may:
a. reproduce the image on any tangible non-software, non-electronically distributed type of product such as shirts, hats and other clothing, mugs and other dishware, small promotional items such as calendars, pens, toys, bags, binders, etc.
b. you may alter the image file to suit your visual needs
c. in the normal course of workflow, convey to third parties such as printers a temporary copy of a file that is integral to your work product and without which the product could not be completed.
d. print a copy of the photo for your own use in any size, but you may not resell it, or redistribute it to others in any way.
Acceptable uses include but are not limited to print media, consumer merchandise, clothing, book and album covers, product packaging, advertisements, newsletters, educational materials, and promotional materials. Software or electronically distributed products are a non-acceptable use of this license.
Prohibited Uses.
You may not:
a. use images in any way that constitutes a violation of the rights of individuals such as defamation, intrusion on privacy, misappropriation of likeness, or depiction in a false light.
b. use images in any way that violates civil and criminal laws such as those regulating pornography, obscenity, fraudulent schemes, counterfeiting, espionage, and aid to illicit activities.
c. use the file in any software or electronically distributed product.
d. resell or re-distribute the BigStockPhoto.com electronic image file itself in any way
e. reverse engineer, decompile, or disassemble any part of a file or accompanying materials except as permitted by law.
f. use any part of an image as a trademark, service mark, logo, or part thereof.
g. remove any copyright or trademark information from any place in the files or accompanying materials.
h. display or post multiple images obtained from the BigStockPhoto.com Website in a size larger than 800 pixels in a stand-alone or gallery format that makes it easy for people to copy, save or steal the photos.
Modification of Photo Usage Agreement
The BigStockPhoto Photo Usage Agreement posted on the BigStockPhoto.com website works in conjunction with this agreement, so they should be followed together, however this agreement supercedes any contradictory passages within the Photo Usage Agreement, in regards to your ability to use the images for the purpose noted above.
All other passages within the BigStockPhoto Photo Usage Agreement remain in full effect, please be sure to read them carefully and to consult legal counsel as needed.
Entire Agreement
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. THIS IS A LIMITED USE ONLINE SOFTWARE LICENSE GOOD FOR up to 100,000 users for one installation of said ONLINE SOFTWARE at a size of 800 pixels or less. YOU AGREE TO REPURCHASE EACH IMAGE USED WITHIN YOUR ONLINE SOFTWARE PRODUCT if your userbase exceeds 100,000 users, and to repurchase the image if you wish to use it within any FUTURE PRODUCTS or ADDITIONAL INSTALLATIONS of your software.
In other words if you use a BigStockPhoto.com image of a horse within your online software product at www.yoursiteURL.com and you wish to also make your online software available at a secondary web site, you must purchase the image of the horse at BigStockPhoto.com TWO times - once for each live site where the image is in use. Also if your userbase exceeds 100,000 users you must re-purchase the image for the second 100,000 users, or upgrade to an Unlimited License.
